Breaking News: Jillian Michaels Sued for False Advertising over Diet Supplement

Posted Feb 12 2010 2:00am

Jillian Michaels, star of the hit reality show “The Biggest Loser” on NBC, is being sued for claims of false advertisement for her product called “Jillian Michaels’ Maximum Strength Calorie Control”.

This product is not among the products that are sold on the website for “The Biggest Loser”.

The woman, Christie Christensen of Lake Ellsinore, California, is claiming that she has “struggled with weight loss her entire life” and that she only bought the product because it’s endorsed by Jillian Michaels. She is seeking this class-action status for this case because she claims that she was duped into buying this product, which failed to give her any results after a month of using the product.

On the packaging of the product, there is a picture of Jillian Michaels, her endorsement and a claim stating “Two Capsules Before Main Meals and You Lose Weight… That’s It!” Also on the packing is a brief description of Jillian Michaels, touting her as “America’s Toughest Trainer.”

The actual lawsuit states that Ms. Jillian Michaels has enough experience to know that taking two capsules before eating will not miraculously cause weight loss.

However, on the packaging of the product, it reads that this product is not certified by the U.S. FDA and that the manufacturer offers a full money-back guarantee if the product doesn’t have successful results.

The manufacturer of the product, ThinCare, has stated it expects to win the case because “Not only have placebo-controlled, double-blind, published clinical studies been conducted on active calorie-control compound in Jillian Michaels’ Maximum Strength Calorie Control, but that research was reviewed by some of the leading weight-loss experts in the world before Jillian would even put her name on the product.”

Heidi Krupp, Jillian Michaels’ publicist, has been called for a statement, but she has yet to return the call.

What’s your take on all of this who’s right and who’s wrong?  Leave your comments below!
