This week, a San Joaquin County California judge refused to free Jackson Phaysaleum, a prisoner who is in a permanent vegetative state. "Attorneys sought his release under a law that allows an incapacitated inmate to go free if he poses no public risk. Judge Terrence Van Oss. . . was inclined to release the inmate but changed his mind because he feared San JoaquinCounty would end up paying the medical bills."
I would like to see the California BOP seek declaratory relief that it has no legal obligation to continue to provide this care.
