New Case - Illinois v. North Logan Healthcare Center

At the end of March, the Illinois Department of Public Health announced type "A" violations of the Nursing Home Care Act that were cited during July 2007. A type "A" violation, which is the most serious licensure violation imposed by the state, pertains to a condition in which there is a substantial probability that death or serious mental or physical harm will result.
Among the defendant facilities is North Logan Healthcare Center in Danville, Illinois. The IDPH fined North Logan $10,000 for failure to honor an advance directive request by a resident to be resuscitated. The statement of deficiencies states that staff did not conduct CPR on the resident after finding the resident unresponsive.
The resident, identified as R7, had a Power of Attorney for Health Care form dated 02/07/2007 showing that R7 initialed the statement, "I WANT my life to be prolonged and I want life-sustaining treatment to be provided." Accordingly, the Physician's Order Sheet ordered staff to implement a Full Code Status. But when the nurses found R7 not breathing, no effort was made to resuscitate R7.
