This "success in practice" seems to be a big theme from the April 14th hearing. Some hospitals (likeSeton) testified that they regularly (or always) go above and beyond the law. But those in support of the amendment point out that while it is great that some (and perhaps most or even almost all) providers undertake such supererogatory conduct, it is not required. A facility can earn safe harbor protection by doing far less. Indeed, some may be (and some have been) tempted to shoot for the floor. It is those facilities that seem to be the real target of the proposed amendment. |
