The New York City Education Department has booted a first-grader from school because her parents won't get her vaccinated.
The child's doctor says the shots could kill the six-year-old. The family filed a legal medical waiver. But NYC denied it.
"These are doctor's orders. We won't risk her life," says mom Dina Check. "How can NYC know
better than our family doctor? They are holding her education hostage.â€
"This is so hard on our daughter. She wants to be back in her old school with all her friends. What do we tell her?" says Dad.
NYS law states that if a doctor says a vaccine may be detrimental to a child's health, the child is excused from vaccines and can still go to school.
The parents have filed suit against New York City's Department of Education for denying their medical waiver for their child. Long-time family pediatrician Dr. Gabriel says the shots are â€˜life threateningâ€™ to the child.
NYC DOE they say she has to get her shots that could threaten her life or she gets no education. So far, the courts have backed them up.
The Checks filed a request to have their child attend school while the court reaches a decision. They were denied.
The Checks have launched a website www.supportmarysrights.com to gain support for their fight. A fundraiser to offset legal costs is planned for Thursday, October 10th at Li Greci's Stataen Catering Hall, 697 Forest Avenue, State Island, New York.
