My children have just been told their father is going to be put in a facility. They were given no warning and told it was not up to them. Do they have any rights. Does the person need to be conserved first. If they don't want to go and can be cared for at home can the children do anything about it.
Hi - This is always a tough situation for the family. Very likely there is a lot more to the story. Who is making the decision now? Why? Something is spurring this decision on the part of whoever is making it. That doesn't mean that there are no options for the children; it does mean that, as an outsider without all the answers, it is difficult to give them any advice. Yes, everyone has rights, elder or not. No, no one can be moved from his home against his will without legal authority. But be careful in supporting the children to fight this. They may think that they can provide the care their father needs but can they, really? Do they have skills, experience, training? Do they know what he needs on a daily basis? What happens if he doesn't sleep through nights, or resists their help? Will they know what to do? It could be that in-home care has already been tried, or is not available. Thank you. The reason the wife gave was he takes his pills at the wrong time. My questions were why hasn't she kept the pills locked up? Does he have life alert? does she ever leave him home alone? Has she investigated in home care? Why has she told the kids after she made the deposit on the home and has not yet told him? She says they get mad a each other all the time. She says she has to think of herself. They have had time to adjust or to see the place or talk to the doctor. She leaves for the weekend to stay with her girlfriend and the kids stay with him. Something does not add up. The most important question was answered. "No one can be moved from his home against his will without legal authority." That will help them a lot. Thank you very much.
